These Terms of Use for the Art Platform Standoff 2 service
(hereinafter referred to as the «Terms of Use») constitute a legally binding agreement between Axlebolt
Limited (Axlebolt LTD), a company incorporated under the laws of the
Republic of Cyprus, registration number HE 409660 (hereinafter
referred to as «Axlebolt»), and you as a user of the Art Platform Standoff 2 service
(hereinafter referred to as the «User», «You» and derivatives thereof).

By using the Service, including registration, uploading or viewing
content, participating in Creative Contests, voting, interacting with
other users, or accessing any other functionality of the Service, You
or Your legal representative agree(s) to these Terms of Use.

By using the Service, You also agree to the Privacy Policy and the Creative Contest Entries and Rules.
-
If You do not agree with these Terms of Use, please discontinue
access to and use of the Service in any form.
Definitions
-
Some definitions used in these Terms of Use have the following
meanings:

Service (also «Art Platform») – an online platform available at art.standoff2.com,
designed for participation in, viewing, and supporting Users in
Creative Contests organized and administered by Axlebolt. The Service
includes functionality that allows Users to upload, view, and interact
with Creative Content.

Standoff 2 (also the «Game») – a mobile game application under the general name
STANDOFF 2, available for devices operating on iOS and Android
operating systems.

Creative Content – any images, videos, or other materials created and
uploaded by a User to the designated section of the Service.
-
Creative Contest – an event organized within the Service, in which Users
can submit their Creative Content under specified conditions, with
winners determined based on criteria set by Axlebolt.

Account – a User's registered profile within the
Service.
-
Prize – a reward that a User may receive for winning a Creative
Contest, which may include, but is not limited to, in-game items in
the Game, virtual currency in the Game, cash rewards, or other bonuses
determined by Axlebolt.

Moderation – the process of reviewing Creative Content before
publication, during which it may be approved, rejected, or modified in
accordance with the Creative Contest Entries and Rules and/or these
Terms of Use.

The Creative Contest Entries and Rules (also the «Rules») – the Creative Contest
Rules, available at https://art.standoff2.com/en/page/monstersrules.
-
Disqualification – the exclusion of a User or their Creative Content from
participating in a Creative Contest in the event of a violation of
these Terms of Use or the Rules.
Amendment of the Terms of Use

We may amend the Terms of Use and/or the Rules unilaterally.
-
In the event of significant changes, we will notify You via a
notification in the Service or an email before the changes take
effect. However, You are required to regularly check the latest
version of the Terms of Use on your own.

The changes take effect 15 days after their publication.
-
If You continue to use the Service after the effective date of the
changes, this constitutes Your acceptance of the new version of the
Terms of Use and/or the Rules.
Subject
License to use the Service
-
Axlebolt grants the User a non-exclusive, free of charge, revocable,
non-transferable right (license) to use the Service within its
functional capabilities, including but not limited to:
-
uploading Creative Content;
-
participating in Creative Contests;
-
evaluating Creative Content of other Users;
-
giving «Like» marks and other reactions;
-
editing Account data;
-
using other tools and features provided by the Service for personal,
non-commercial purposes.
-
Axlebolt reserves the right to modify, restrict, or terminate access
to specific features of the Service at any time without prior notice
to the User.
Assignment of exclusive rights to creative content
-
By uploading or otherwise submitting Creative Content to the Service,
the User grants Axlebolt an exclusive right to such Creative Content
on an assignment basis, free of charge, for the entire duration of the
exclusive right in accordance with applicable law.

The assignment of exclusive rights includes, but is not limited to,
Axlebolt's right to use, reproduce, modify, adapt, distribute,
display, publish, transfer to third parties, and otherwise dispose of
the Creative Content without any obligation to pay the User any
remuneration.
-
Axlebolt has the right to use the Creative Content without
attribution to the author and without requiring additional consent
from the User.
-
The User guarantees that they have all necessary rights to the
submitted Creative Content and that the transfer of rights to Axlebolt
does not infringe on the rights of third parties.

If, under the laws of Your country, the assignment of exclusive
rights to Creative Content is not possible, You grant Axlebolt an
exclusive, irrevocable, perpetual, royalty-free, and sublicensable
license to use the Creative Content without territorial restrictions.
This license is deemed granted for the entire duration of the
copyright on the Creative Content.

This license includes Axlebolt's right to use, reproduce,
distribute, modify, adapt, translate, transform, publicly display,
publish, sublicense, and otherwise dispose of the Creative Content in
any lawful manner without any obligation to attribute the author or
provide any compensation.

The granted license does not terminate upon the termination of the
Terms of Use.

The User confirms that they have all necessary rights to grant such a
license and that the transfer of rights to Axlebolt does not infringe
on the rights of third parties.

The User acknowledges that both the assignment of exclusive rights to
the Creative Content and the granting of a license to the Creative
Content result in the termination of any rights for the User to use
such content.
Modification of the Service
-
Axlebolt reserves the right to modify, supplement, or remove any
functionality of the Service at any time, as well as change its
appearance, without prior notice to Users.

Axlebolt is not obligated to maintain or support specific features,
interface elements, or functionalities of the Service and bears no
responsibility for any changes in the user experience resulting from
such modifications.

Continued use of the Service after modifications have been made
constitutes the User's acceptance of the updated functionality and
appearance.
Warranties and representations

The User warrants and represents that they:
-
are of legal age and fully capable under the laws of their country to
enter into the Terms of Use; or
-
if the User is a minor or otherwise lacks full legal capacity, they
have obtained consent from their parent or legal guardian to accept
the Terms of Use and use the Service.

Axlebolt has the right to request proof of age and/or parental (legal
guardian) consent at any time. If such proof is not provided, access
to the Service may be restricted or blocked.

The User warrants that they have all necessary rights to the Creative
Content they upload and that the transfer of rights to Axlebolt does
not violate any laws or third-party rights.

If false information regarding age, legal capacity, or the presence
of parental (legal guardian) consent is provided, the User and/or
their legal representative shall bear full responsibility for any
consequences.
Minimum system requirements

For the Service to function properly in the web version, it is
recommended to use devices and software that meet the following
minimum requirements:

Operating system: Windows 10 / macOS 10.13 / Linux (modern
distributions)

Browser: Google Chrome, Mozilla Firefox, Microsoft Edge, Safari
-
Processor: Intel Core i3 / AMD Ryzen 3 or equivalent
- RAM: 4 GB

Screen resolution: Minimum 1280x720
-
Stable internet connection with a minimum speed of 5 Mbps

Axlebolt does not guarantee the proper functioning of the Service on
outdated or unsupported devices and browsers. The User is responsible
for updating their software and ensuring their device meets the
specified requirements.
Support

If You encounter technical difficulties or have questions regarding
the use of the Service, You can contact the support team for
assistance using the functionality available on
help.standoff2.com.
Description of the Service
Service functionality
-
When accessing the Service without logging into an Account, the User
has the ability to:
-
View the Service's main page;
-
View Creative Contest pages;
-
View individual Creative Content;
-
Switch the interface language;
-
Contact support;
-
Log into the Service/register in the Service.
-
When accessing the Service with an Account, the User gains the
ability to:
-
Upload or change the Account profile picture (avatar);
-
Change or add the displayed Account name (login);
-
Specify their game ID (UID in Standoff 2);
-
Add contact details;
-
Delete their Account;
-
Upload Creative Content to participate in a Creative Contest;
-
Receive system notifications about the status of their Creative
Content;
-
Track the status of their Creative Content in their Account's
personal dashboard;
-
If Creative Content is rejected during Moderation, upload new
Creative Content, provided that the Creative Contest is still
accepting submissions;
-
Switch the interface language;
-
Contact support;
-
Vote for Creative Content submitted by other Users.
Restrictions on the use of the Service
-
The User is not able to:
-
Delete Creative Content that has already been submitted to a Creative
Contest;
-
Change the email address provided during Account registration.
Prize and winner determination
-
A User recognized as a winner of a Creative Contest may receive a
Prize in accordance with the conditions of the Creative Contest.
-
The determination of winners may be carried out in various ways,
including but not limited to:
-
Voting by Users;
-
Selection of winners by Axlebolt;
-
Selection by Axlebolt's partners (e.g., bloggers, etc.);
-
A combination of multiple methods at Axlebolt's discretion.
-
The decision on the determination of winners is final and not subject
to review or appeal.
-
Axlebolt will contact the winner using the contact details provided
in the User's personal account to clarify the details of receiving
the Prize. The User must respond within 10 business days. If the User
does not respond within the specified period or provides incorrect
contact information, Axlebolt has the right to cancel the Prize.
-
The User is responsible for paying all applicable taxes, fees, and
other mandatory payments on the Prize received in accordance with the
applicable legislation. The User independently bears responsibility
for the payment of all required charges related to receiving the
Prize, in compliance with the laws of their jurisdiction.
-
To receive the Prize, Axlebolt may request the necessary documents
from the User, including but not limited to: payment details or other
financial information if required for the Prize transfer; other
documents required by law or Axlebolt's internal procedures.
-
Axlebolt has the right to refuse to issue the Prize if the User:
fails to provide the requested documents within the specified period;
provides knowingly false, inaccurate, or forged information; fails to
comply with the legal requirements related to receiving the
Prize.
Requirements for Creative Content
-
The User bears full responsibility for the Creative Content they
upload and guarantees its compliance with the Terms of Use and
applicable law.

Axlebolt reserves the right to moderate, remove, or reject Creative
Content without prior notice to the User if the content does not
comply with the Service's requirements.
-
Creative Content uploaded to the Service must comply with the
Creative Contest Rules as well as the following requirements:
-
Creative Content must not infringe exclusive intellectual property
rights, trade secrets, image rights, privacy rights, or any other
rights of third parties.
-
Creative Content must not contain information that violates
applicable law; obscene language, offensive, threatening, indecent,
defamatory, or slanderous materials; promotion of illegal activities
or behavior; extremist, terrorist, fascist, or other radical
ideologies; materials containing religious, social, racist, sexist, or
political statements; sexually explicit content, including references
to sexual orientation, erotic, or pornographic elements.

Creative Content must not contain viruses, advertisements for
malicious resources, phishing links, or other fraudulent
elements.
-
Creative Content must not contain spam, excessive repetitive
messages, advertisements for narcotic or psychotropic substances, or
promote their use.
-
Creative Content must not contain information about the sale,
transfer, or modification of access rights to Standoff 2 Game
profiles.
-
Creative Content must not contain demonstrations or discussions of
methods for bypassing Standoff 2 security mechanisms, gaining unfair
advantages ("cheats"), technical vulnerabilities
("bugs"), or any other activities not expressly approved by
Axlebolt.
-
Creative Content must not contain information about Axlebolt's
activities unrelated to Standoff 2, as well as personal information of
Axlebolt's employees, contractors, founders, directors, or their
family members.
-
Creative Content must not contain third-party personal data if such
data was obtained or used without the consent of the relevant
individuals.
Prohibited use of the Service
-
The User is prohibited from:
-
Uploading, distributing, or using malicious software, viruses, or
other technologies that could harm the Service or its users;
-
Using the Service for phishing, fraud, or collecting personal data
without permission;
-
Uploading or distributing content containing links to phishing sites,
fraudulent schemes, or resources with malicious software;
-
Artificially inflating "Like" marks, votes, or otherwise
manipulating the results of Creative Contests or interactions with
Service content;
-
Using automated tools (bots, scripts, parsers) to gain advantages,
collect data, or interact with the Service;
-
Interfering with the Service's operation, its algorithms, or
technical mechanisms;
-
Impersonating the administration, Axlebolt representatives, or other
persons related to the management of the Service;
-
Distributing spam, bulk commercial offers, inappropriate
advertisements, or offers not approved by Axlebolt;
-
Posting links to third-party resources unless explicitly allowed by
the Service’s functionality;
-
Using any methods to bypass authentication systems, data protection,
or other technical restrictions of the Service;
-
Modifying, decompiling, disassembling, or otherwise attempting to
alter the Service’s source code or analyzing it for
vulnerabilities;
-
Attempting unauthorized access to other users’ accounts,
Axlebolt's internal systems, or databases;
-
Initiating DDoS attacks aimed at disrupting the Service's
functionality or participating in such attacks;
-
Sharing information about ways to exploit vulnerabilities, bypass
protections, or perform other actions that disrupt the Service's
operation.
-
In case of a violation of these rules, Axlebolt has the right to take
measures, including but not limited to:
-
Removing or blocking Creative Content;
-
Temporarily or permanently restricting access to the Service;
-
Canceling participation in Creative Contests and disqualifying the
User from receiving a Prize;
-
Deleting the User’s account without the possibility of
recovery;
-
Seeking compensation for damages incurred;
-
Reporting violations to competent authorities if the User’s
actions indicate possible illegal activity.
Termination of the Terms of Use
-
The maintenance of the Service does not create any obligations for
Axlebolt to continue its operation in the future. Axlebolt has the
right to terminate or suspend the Service, in whole or in part, at any
time without prior notice to Users.

Axlebolt has the right to terminate the Terms of Use at any
time.
-
If the User violates the Terms of Use, as well as any other terms,
policies, or rules referenced in the Terms of Use, Axlebolt has the
right to immediately terminate the User’s access to the Service
without prior notice.

In the event of termination of the Terms of Use, Axlebolt’s
rights to Creative Content previously uploaded by the User shall
remain in effect in accordance with the conditions set forth in the
Terms of Use.
-
The User has the right to stop using the Service at any time by
deleting their Account.
-
Termination of the Terms of Use for any reason does not release the
User from obligations incurred before its termination.
Dispute resolution and governing law
-
The Terms of Use and any non-contractual obligations arising from or
in connection with it, the conditions for recognizing the Terms of Use
or any of its parts as void, invalid, or unenforceable, the
consequences of such recognition, and all similar matters shall be
governed by and interpreted in accordance with the laws of the
Republic of Cyprus.

The Parties agree to resolve disputes through negotiations. Users
must contact support via the functionality available on
help.standoff2.com, specifying that the matter should be brought to
the attention of Axlebolt’s legal department. The Axlebolt legal
team shall provide a written response within 10 (ten) business days
through the User’s contact details specified in the request,
until the matter is resolved.

If a dispute cannot be resolved through negotiations, You agree to
the exclusive jurisdiction and venue of the appropriate court located
in the Republic of Cyprus, and You unconditionally submit to the
jurisdiction of such court and agree to waive any objections regarding
the inconvenience of such courts as a forum.
Limitation of liability
-
The Service is provided «as is» and «as
available», without any express or implied warranties.

Axlebolt does not guarantee that:
-
The Service will operate without interruptions, errors, or other
defects;
-
The Service will meet the User’s expectations;
-
Access to the Service will be provided continuously or without
technical failures.
-
Axlebolt is not liable for:
-
Temporary or permanent failures in the operation of the Service,
including its unavailability due to technical reasons, server attacks,
internet connection failures, or other circumstances;
-
Possible errors, inaccuracies, or improper functioning of the
Service;
-
The security of the User’s data if third parties gain access to
their Account due to password loss, phishing, malware, or other
factors beyond Axlebolt's control.
-
Axlebolt, as well as its affiliated legal entities, are not liable to
the User or third parties for:
-
Any losses, including lost profits, data loss, reputational damage,
or other indirect, incidental, or consequential damages arising from
the use of the Service or the inability to use it;
-
Any actions of third parties, including other users of the
Service;
-
Content uploaded, published, or distributed by Users, as well as its
compliance with applicable law and third-party rights.

The User agrees to defend, indemnify, and hold Axlebolt, its
affiliates, employees, contractors, and partners harmless from any
claims, lawsuits, demands, losses, liabilities, or expenses (including
reasonable legal fees) arising from: the User’s violation of the
Terms of Use, use of the Service in violation of applicable law or
third-party rights, uploading, distribution, or use of Creative
Content that infringes on third-party rights, or any fraud, deception,
or other unlawful actions committed by the User.
Severability, divisibility, and assignment of rights

If any provision of the Terms of Use is or becomes invalid, illegal,
or unenforceable under the applicable laws or regulations of any
jurisdiction, such provision shall be deemed modified in accordance
with such laws or regulations without materially altering the intent
of the parties and shall be enforced accordingly, or it shall be
removed, while the remaining provisions of the Terms of Use shall
remain in full force and effect.

If Axlebolt is unable to enforce the Terms of Use in a timely manner,
this shall in no way be interpreted as a waiver of Axlebolt’s
rights concerning past or future obligations.

Axlebolt has the right to transfer (assign) any or all of its rights
and/or obligations concerning the User to any third party. The User
may not transfer (assign) any or all rights and/or obligations under
the Terms of Use to any third party without Axlebolt’s prior
consent.
